By using the website located at yubacityasphaltpaving.com (the "Site") or by requesting, scheduling, or receiving services from Yuba City Asphalt Paving ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or engage our services.
Yuba City Asphalt Paving is located at 807 Olive St, Yuba City, CA 95991. These terms govern your use of our website and your relationship with us as a customer or prospective customer.
Yuba City Asphalt Paving provides asphalt paving, sealcoating, crack sealing, striping, grading, and related pavement services to residential and commercial property owners in the Yuba City, CA area and surrounding communities. All services are subject to availability, site conditions, and the specific scope agreed upon in writing before work begins.
Use of our Site to request information or submit an inquiry does not constitute a binding service agreement. A binding agreement is formed only when a written estimate or contract is signed by both parties and any required deposit is received.
All estimates provided by Yuba City Asphalt Paving are based on conditions observed at the time of the site visit and the information you provide. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Final pricing may change if site conditions differ materially from what was observed during the estimate, if the scope of work changes at the customer's request, or if unforeseen conditions are discovered during the work (such as unstable base material, hidden drainage issues, or subsurface obstacles). We will notify you of any material cost change before proceeding with additional work beyond the original estimate.
All prices are in U.S. dollars. Taxes, permit fees (if applicable), and material surcharges will be disclosed in the written estimate.
Work is scheduled upon receipt of a signed estimate and any required deposit. Scheduling is subject to crew availability, weather conditions, and material lead times.
We reserve the right to reschedule jobs due to weather, equipment issues, or other circumstances outside our control. We will notify you as soon as reasonably possible if a rescheduling is necessary.
If you need to cancel a scheduled job, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start may result in forfeiture of any deposit paid to cover mobilization costs. If we cancel the job for reasons within our control, your deposit will be refunded in full.
Payment terms are stated in the written estimate or contract. In most cases, a deposit is due upon signing, with the balance due upon completion of the work. We accept cash, check, and electronic payment methods as agreed in writing.
Invoices not paid within 30 days of the due date may be subject to a late fee as permitted under California law. Nonpayment may result in suspension of any warranty, referral to collections, or other legal action.
Disputed invoices must be raised in writing within 10 days of receipt. Failure to dispute an invoice within that period constitutes acceptance of the charges.
Yuba City Asphalt Paving warrants that work will be performed in a workmanlike manner consistent with industry standards for the Yuba City, CA region. Any specific warranty terms will be stated in the written estimate or contract.
Warranties do not cover damage resulting from: acts of nature (including flooding, earthquakes, or extreme weather events), customer misuse or neglect, third-party modifications to the work, underlying soil conditions or drainage issues not disclosed prior to work, or normal wear and tear.
The Site and any information provided on it are offered "as is" without warranty of any kind. We do not warrant that the Site will be error-free or uninterrupted.
You agree to provide accurate information when requesting services, including a correct service address, access to the work area, and disclosure of any known site conditions that may affect the work (such as buried utilities, known drainage problems, or prior repairs).
You are responsible for locating and marking all underground utilities before work begins. Yuba City Asphalt Paving is not liable for damage to unmarked utilities. We recommend contacting California 811 (Underground Service Alert) before any digging or excavation work.
You agree to keep vehicles and foot traffic off freshly completed surfaces for the cure period communicated by our crew. Damage caused by failure to observe this requirement is not covered under any warranty.
To the fullest extent permitted by California law, Yuba City Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or the use of our Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from services we perform shall not exceed the total amount paid by you for the specific work giving rise to the claim.
If you have a dispute with us related to our services or these terms, please contact us first at team@yubacityasphaltpaving.com or (530) 399-1917. We will make a good-faith effort to resolve the issue directly.
If we are unable to resolve a dispute informally, both parties agree to attempt mediation before pursuing litigation. Mediation shall take place in Sutter County, California.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising under these terms shall be filed in the appropriate courts of Sutter County, California.
We reserve the right to modify these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Continued use of the Site or engagement of our services after any modification constitutes acceptance of the revised terms. We encourage you to review this page periodically.
